So you’ve just been arrested. Maybe it was a DUI or maybe your significant other and you got into an altercation and the neighbors called law enforcement. Whatever it was, now you find yourself in the back of a squad car headed for jail. You have never been arrested before, you have not so much as a traffic ticket on your record, and you have no idea what’s going to happen.
A couple of things to keep in mind: You have the right to remain silent, and you should exercise that right. You don’t have to make any incriminating statements to law enforcement, and once you say the magic words, “I don’t walk to talk to you, I want to speak with an attorney,” that should be the end of it. But if not, just keep repeating that phrase over and over again. The vast majority of police officers will cease questioning though, once you’ve said those words, and your criminal defense attorney should sweep in.
If you’ve been arrested for a DUI, you are required by law to submit to a chemical test, whether it’s blood, breath or urine. It’s referred to as “implied consent”. Driving is a privilege, not a right, and your consent to be tested by law enforcement if they have a reasonable suspicion that you’ve been driving while impaired was implied when you applied for your license.
Your refusal to be tested could result in a forced blood draw upon the issuance of a warrant, and your license to drive WILL BE SUSPENDED by the Dept. of Motor Vehicles for ONE YEAR, even if you have no alcohol or drugs in your system.
Whatever you’re charged with, you may think you’re guilty and that there is no reason to fight the case. Nothing could be further from the truth. You need a skilled criminal defense attorney like Jeff Hammond to review all the facts of your case, looking for errors by law enforcement during the arrest, and any mitigating factors that can help you, or result in a more favorable disposition.
If you find yourself in this situation, call a criminal defense lawyer you can trust. Criminal defense attorney Jeffery E. Hammond offers help you need and deserve. He’ll be at your side every step of the way!
